In many respected jurisdictions – most notably the United Kingdom – it is common practice for witnesses to be interviewed and reassured by a public official before entering the courtroom to give their testimony. These moments of support are widely considered essential, as the rituals and formalities of justice such as impartial scrutiny, public examination, confrontation, cross‑examination, and even the presence of the accused will often cause considerable distress, which may compromise the quality of evidence on which justice can solely rely.

Just as importantly, similar concerns also arise within the legal counselling profession itself, where the emotional toll of disclosure can be equally profound and deeply distressing. This becomes especially pressing in cases involving children and sexual offences, where fear and trauma will often silence even the most urgent truths. It is therefore vital to create an atmosphere of trust and safety in which individuals may feel empowered to speak without fear of judgment or reprisal, and with the confidence that their disclosures will be treated with the utmost care and confidentiality.

For only then, and only after such fragile confidence‑building efforts, can a legal professional truly fulfil their purpose, that is, to speak on behalf of those who may not be able to speak for themselves.

With this in mind, the legal profession has long developed practices that protect both the integrity of testimony and the wellbeing of those involved. Indeed, countless courtroom experiences have demonstrated how far small gestures of kindness can go – whether a reassuring smile or a moment of gentle humour – in helping someone find the courage to speak openly and firmly.

On Wit, Warmth, and the Craft of Legal Writing

Therefore, during our writing we will, on occasion, employ wit, irony, or even a touch of carefully measured sarcasm, even in our professional engagements, for such gestures can only help empower individuals who may be experiencing trauma, while also fostering warmth and openness and ensuring that, by momentarily sharpening attention, our technical message is not overlooked. And when a client or witness finds the courage to disclose, the process of law and justice becomes a shared forging: layer by layer, resilience and precision take shape, as if two craftsmen were standing at the same fire, shaping a blade that must be both strong and true.

However, two additional reasons also justify our approach. First, because we aim to make the reading experience more engaging and meaningful. To that end, we may draw on poetry, historical references, familiar quotations, and even our own—admittedly second‑line—attempts at verse. After all, one must remember that even Sherlock Holmes, for all his brilliance as a detective, was a rather trying violist.

Second, for a more self‑interested reason: because by doing so we also hope to invite you into our services through passion, commitment, and goodwill rather than through mere inevitability, obligation, or any sense of coercion, which is all too often the subject of complaint. And for that, our work must also distinguish itself in ways that earn your trust, your confidence, and, in time, your preference.
